Indemnity Clause for Rental Car Services

1. Service Description: Yellow Sands Luxury Villas Inc. (hereinafter referred to as ” Yellow Sands “) offers rental car services to its guests through an arrangement with external rental car service providers (hereinafter referred to as “Car Service Providers”). Yellow Sands serves solely as an intermediary in facilitating the booking of these services and does not directly provide rental car services.
2. Indemnification: The guest (hereinafter referred to as “Guest”) agrees to indemnify, defend, and hold harmless Yellow Sands, its owners, managers, partners, agents, employees, and affiliated entities from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) that may arise from or in connection with the Guest’s use of the rental car services. This indemnification includes, but is not limited to, any incident involving the rental car during the rental period, including accidents, damage, loss of property, injury, and death.
3. Third-Party Services: The Guest acknowledges that the rental car services are provided by Car Service Providers, and Yellow Sands is not responsible for the actions, conduct, performance, or negligence of these providers. Any claims or disputes arising from the use of rental car services shall be directly addressed to and resolved with the Car Service Providers.
4. Insurance and Liability: The Guest is strongly advised to review and understand the terms and conditions of the rental agreement with the Car Service Providers, including insurance coverage and liability provisions. Yellow Sands recommends that the Guest obtain appropriate insurance coverage for the rental period.
5. Limitation of Liability: Yellow Sands shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of rental car services, regardless of the basis of the claim and even if Yellow Sands has been advised of the possibility of such damages.
6. Acknowledgment and Consent: By using the rental car services arranged by Yellow Sands, the Guest acknowledges and agrees to the terms of this indemnity clause, and represents that they have read, understood, and accepted the terms and conditions herein.
