Indemnity Clause for Spa Services
- Service Overview: Yellow Sands Luxury Villas Inc. (hereinafter referred to as ” Yellow Sands “) offers access to spa services either on premises or outside of premises to its guests through partnerships with external spa service providers (hereinafter referred to as “Spa Service Providers”). Yellow Sands acts solely as a facilitator for these services and does not directly provide spa treatments or therapies.
- Indemnification: The guest (hereinafter referred to as “Guest”) agrees to indemnify, defend, and hold harmless Yellow Sands, its owners, managers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys’ fees) arising from or in connection with the Guest’s use of the spa services. This includes, but is not limited to, personal injuries, skin reactions, health conditions, or any other issues experienced during or following the spa treatments.
- Third-Party Services: The Guest acknowledges that the spa services are provided by Spa Service Providers, and Yellow Sands is not responsible for the actions, conduct, professionalism, or negligence of these providers. Any disputes or claims arising from the provision of spa services shall be addressed directly with the Spa Service Providers.
- Health and Safety: The Guest is responsible for informing the Spa Service Providers of any health issues, allergies, or specific needs that may affect their spa treatment. Yellow Sands advises the Guest to seek professional medical advice if unsure about the suitability of spa treatments for their health condition.
- Limitation of Liability: Yellow Sands shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of the spa services. Yellow Sands liability is limited to the facilitation of the booking of these services and does not extend to the actual provision of spa treatments.
- Acknowledgment and Consent: By utilizing the spa services arranged by Yellow Sands, the Guest acknowledges having read, understood, and agreed to the terms of this indemnity clause. The Guest consents to the limitations of liability and assumes all risks associated with the use of spa services.
